TRIBAL BUSINESS COUNCIL SPECIAL MEETING 08-28-VJB September 12, 2008, 10:00 A.M. I. CALL TO ORDER: Meeting called to order at 10:46 A.M.
II. PRAYER: Roger Bird Bear
III. ROLL CALL: Councilwoman Hale, Councilman Wolf, Chairman Wells Jr., Councilman Malcolm Wolf, Councilman Mervin Packineau, and Councilwoman V. Judy Brugh are present. A quorum is established. Councilman Barry Benson arrived at 11:05 A.M.
IV. APPROVAL OF AGENDA: All reserved additions. I.H.S. Report
Councilwoman Hale moved to approve the agenda as amended, seconded by Councilman Packineau. Discussion: Is Aileen Jackson to be here. Yes. VOTE: 5 Ayes 0 Nays Motion carried.
V. APPROVAL OF MINUTES: Deferred.
VI. OTHER: A. 638 I.H.S. Contract Report Discussion: Randy Grinnell one of the deputy directors, and Charlene Red Thunder were present on a conference call. IPA’s not producing paper work and doing their own thing. Brenda Stubstadt is the person that workers have been going through for leave and signing off. Tuesday a meeting was held in Aberdeen that Stella Berquist and Aileen Jackson attended. April 1 to current, undermining has been going on. Michelle is willing to come to Ft. Berthold to have a special meeting. Meeting date is set for Randy to look at each IPA to find out if $9,000.00 per month is normal. It is an annual payment or MOA. Only effective if it is a new IPA. Payroll for pharmacy Personal question from Stella. The tribe is not getting their money back. Transfer of IPA to different service unit would cause an interruption at Minni Tohe. Deb Jeanotte & Sherrie Smith, if they except a position then Aberdeen will call and let Stella know. A letter will be done by Charlene RT. October 1, 2008 at 10:00 A.M. will be a Special TBC meeting on 638 I.H.S. to meet with the Tribe to go over any issues and to tour the facilities and to talk to the IPA’s. Randy will meet with Charlene after the October 1st meeting and then will follow up with Mr. McSwain. Third party billing 3000 bills still waiting to be paid before we can get started. Kim Craig is transferring out to Ft. Totten she said they can be done from Aberdeen Area. When Kurt Bruer was there he didn’t give a copy of to Aileen or Stella. Call ended at 12:00 P.M. Marcus Wells Sr. addressed the Tribal Business Council on the funding and third party billing.
B. Marcus Wells Sr. Audit He addressed the Tribal Business Council on the audit.
C. Tribal Housing to repay EPA for Makoti Cleanup Cammie Gosnell addressed the issue to the council.
D. I.H.S. 638-Councilman Benson A report done by his assistant.
VII. Personnel (closed session)-Barlow Wells Barlow is completed with his hires.
VIII. Bernadine Young Bird Could not be here.
IX. Independence Loans: Ambrose Hosie He did not present.
X. Chief Financial Officer Report: Whitney Bell CFO He did not present.
XI. Rescind 08-119-VJB: Jen Fyten She did not present.
XII. Resolution: Stephans Energy This was not presented.
XIII. TRIAD Oil Refinery: Horace Pipe He did not present.
XIV. Nueta Nations: Daylon Spotted Bear He did not present.
XV. Loan Request for Yolanda Bearstail Manager of White Shield C-Store Councilman Packineau moved to approve a loan in the amount of 13,000.00 for to be drawn up by Legal department to be taken out of the general fund. This is contingent on a promissory note being signed by Yolanda Bearstail, Manager of the White Shield C-Store. The motion is seconded by Councilman Benson.
Discussion: What kind of collateral will be put up? To go through finance department with this loan. VOTE: 5 Ayes 0 Nays Motion carried.
XVI. Resolution 08-154-VJB: Fractionated Mineral Interests Councilman Packineau moved to approve a resolution entitled, “Approval to lease 320.00 acres, wherein the Tribe owns an undivided interest of Allotted trust lands to Peak North Dakota, LLC, for Oil and Gas Development on the Fort Berthold Reservation pursuant to 25 CFR 211 and Request to the Superintendent to Negotiate a Lease Pursuant to 25 CFR 211.20 (a) And (d)”. The motion is seconded by Councilwoman Brugh.
Discussion: The tribe owns only 11% interest and doesn’t have any bargaining power. The tribe is holding up the allot tees from getting their money if they don’t pass this. VOTE: 5 Ayes 0 Nays Motion carried.
XVII. ADJOURNMENT: Councilman Packineau moved to adjourn, seconded by Councilwoman Hale.
Meeting adjourned at 2:57 P.M.
