I.                   CALL TO ORDER:

The meeting was called to order at 3:49 P.M.

II.                PRAYER:

Spencer Wilkinson Jr.

III.             ROLL CALL:

Councilman Barry Benson, Councilman Frank Whitecalfe, Councilman Mervin Packineau, Chairman Marcus Levings, Councilman Scott Eagle, and Councilwoman V. Judy Brugh are present.  A quorum is established.   For the record, Councilman Arnold Strahs is not present.

IV.             APPROVAL OF AGENDA:

Councilman Packineau moved to approve of the one agenda item, second by Councilwoman Brugh.

Discussion:               No discussion.

               VOTE:                        5 Ayes 0 Nays Motion carried.

V.                LSA Forbearance-Damon Williams, TAT Legal Department/Michael Roy, Hobbs, Straus, Dean, & Walker

Recessed at 4:25 P.M.

Reconvened at 5:05 P.M.

A.    Resolution 09-137-VJB: Totten Builders Settlement of Judgment

Councilman Packineau moved to approve of a resolution entitled, “Settlement of Judgment in Totten Builders and Supply Claim – Lake Sakakawea and Associates, LLC.”  The motion is second by Councilman Eagle.

Discussion:               The council has a long discussion on financials.          

VOTE:                        4 Ayes 0 Nays 2 Abstentions Motion carried.

B.    Resolution 09-138-VJB: Terms in Forbearance Agreement 6:45 P.M.

Councilman Packineau moved to approve of a resolution entitled, “Forbearance Agreement, Security and Settlement Agreement – Lake Sakakawea & Associates, LLC.”  The motion dies due to lack of a second.

Councilman Packineau moved to approve of a resolution entitled, “Forbearance Agreement, Security and Settlement Agreement – Lake Sakakawea & Associates, LLC.”  The motion is second by Councilman Benson.

Discussion:               The Council is reminded of the weight of signing documents.                                  

VOTE:                        5 Ayes 0 Nays 1 Abstention Motion carried.

VI.             ADJOURNMENT:

Councilwoman Brugh moved to adjourn the meeting, second by Councilman Benson.

Meeting adjourned at 6:58 P.M.
