I.                   CALL TO ORDER:

The meeting was called to order at 10:38 A.M. 

This is meeting #162 of the Wells-Levings administration.

 

II.                PRAYER:

Councilman Strahs.

 

III.             ROLL CALL:

Councilman Barry Benson, Councilman Arnold Strahs, Chairman Marcus Levings, Councilman Scott Eagle, Councilman Mervin Packineau, Councilwoman V. Judy Brugh are present.  A quorum is established.  For the record Councilman Frank Whitecalfe is not present. 

 

IV.             APPROVAL OF AGENDA:

Councilman Strahs moved to approve of the agenda, second by Councilman Benson.

VOTE:                        5 Ayes 0 Nays Motion carried.

 

V.                FBHA: Home Conveyances: Becky Knight/Diane Johnson

VI.             Ceiling Rent: Becky Knight

VII.          Resolution: Prevailing Wage Rate: Diane Johnson

Tabled until the Regular Tribal Business Council meeting on October 8, 2009.

This is forwarded to the October 8, 2009 regular TBC.

 

IX.             TERO: Dewey Hosie/TERO Committee

Councilman Eagle moved to approve out of the TERO Funds, a training fee in the amount of $50,000.00 that is in TERO called Bureau of Apprenticeship and training for First Nations Innovation.  The motion is second by Councilman Strahs.

 

Discussion:               First Nations Innovations is a nonprofit organization that is comprised of Lisa Redford, Ed Danks, Dave Brunsel, and Clarence O’Berry. This is separate from TERO because they are non-profit.  They can answer to the Director but not to come to the TERO Board.  A part of the $50,000.00 is a board member of the TERO Commission Board will be on the First Nation Innovations Organization. This is a onetime thing, and they will go out and seek funding on their own. This will help all Native American Contractors occupations.   This Office will help those Businesses with accounting, writing a safety program, making sure taxes are paid on time, paying workmen’s comp, structured controlled growth, help with going to a bank, etc.  The call center is separate from this.     

VOTE:                        4 Ayes 0 Nays 1 Abstention Motion carried.

 

X.                Resolution 09-148-VJB: Appointment of 2009 Delegates to the NCAI

Councilman Strahs moved to approve of a resolution entitled, “Appointment of 2009 Delegates to the National Congress of American Indians.”  The motion is second by Councilman Eagle.

VOTE:                        5 Ayes 0 Nays Motion carried.

 

XI.             Resolution 09-147-VJB: Declination to Refinery

For the record: Resolution number 147 is given to a resolution to decline the extension on the EPA for the Oil refinery.

XIV.       IRR Bills for Jack Sawyer Asphalt and Paving:

Councilwoman Brugh moved to approve the two projects the IRR paving, pothole fixing, and the road inventory for the Four Bears Segment that includes BIA #2 for Jack Sawyer.  This is subject to completing projects in Twin Buttes, the walking path and widening approach.  The motion is second by Councilman     Eagle.

 

Discussion:                Dodger Construction is the other vendor that needed approval for a change order.  On Councilwoman Brugh’s paper work, they had an extra $100,000.00 in there for the earthlodge villages, so we can wash some of that.  Joan Fredericks said there was $100,000.00 in there, so whatever tallys this total amount.  Dodger Construction is owed $39,000.00 plus or minus.  The Four Bears is $93,800.00.  The one given to Pat Wilkinson is Tourism Earth lodge Village which is 190,000.00 but she is going to negotiate down to 100,000.00. She tried but he said the $100,000.00 now and the other in 60 days, however the paper work is handled.  Lenny advised that $100,000.00 was paid on Friday to the Tourism bill.  The second was the roads in Four Bears which included Dragswolf streets and highway #2. 

              VOTE:                         5 Ayes 0 Nays Motion carried.

 

 

XV.          Small Loans

Motion on the floor for Iris Jackson for legal fees, Onalea Johnson for moving fees, and Tammy Lockwood for Independence loan for a total of $8,700.00.  Motion dies.   

 

XVI.       FBRW: BOR: Marvin Danks

A.     Resolution 09-149-VJB: Final Loan Closing

Councilman Strahs moved to approve of a resolution entitled, “Approval of Application for a loan and a Grant from the USDA Rural Development in the Amount of $2,497,000.00 for the West Segment-Mandaree Water Source Distribution and Storage Project for the Fort Berthold Rural Water System.”  The motion is second by Councilman Eagle.

              VOTE:                        5 Ayes 0 Nays Motion carried.

 

B.     Resolution 09-150-VJB: Parshall Water Agreement

Councilman Benson moved to approve of a resolution entitled, “Approval of Water Supply Contract between the Three Affiliated Tribe and the City of Parshall.”  The motion is second by Councilman Strahs.

 

              Discussion:                Good old boy comments were heard in public comments.

              VOTE:                         5 Ayes 0 Nays Motion carried.

 

XVII.    Resolution 09-151-VJB: Kennedy Report: Vonnie Alberts

Councilman Eagle moved to approve of a resolution entitled, “Resolution in Support of the 40th Anniversary of the Kennedy Report on Indian Education entitled “Indian Education, a National Tragedy, and National Challenge.”  The motion is second by Councilman Strahs.

 

Discussion:                The Senate Committee on Indian Affairs hasn’t had a public hearing in three years on Indian Education and so  is part of this is tribes coming together to try to call the Indian Affairs Committee to host the listening session on any current Indian Education Issues across Indian Country. The Three Affiliated Tribes along with Chairman Levings has already been invited to host this event in Washington D.C. at the National Museum of the American Indian and during that same day, NCAI is going to be doing their grand opening on November 3rd of their Indian embassy headquarters that they just opened. 

             VOTE:                         5 Ayes 0 Nays Motion carried.

 

XVIII. Resolution 09-152-VJB: Wells Fargo

Councilman Strahs moved to approve of a resolution entitled, “ Authorization to Open an Account with Wells Fargo Bank, NA.”  The motion is second by Councilman Eagle.

 

Discussion:                Councilman Eagle said he knows this is with a recommendation from TAT Attorney, but he don’t like anything with Wells Fargo name on it.

              VOTE:                         5 Ayes 0 Nays Motion carried.

 

XIX.       Energy Efficiency: Waylon Pretends Eagle, CEDS
