BUSINESS COUNCIL SPECIAL MEETING
10-03-VJB I.
CALL TO ORDER: The meeting was called to order at This is meeting #179 of the Levings administration. II.
PRAYER: Terry Red Fox gave the invocation. III.
Chairman Marcus Levings, Councilman Frank Whitecalfe, Councilman
Mervin Packineau, Councilwoman V. Judy Brugh, Councilman Scott Eagle
(Conference call), and Councilman Arnold Strahs (Conference call) are
present. A quorum is established. For the record, Councilman Barry Benson is
not present. IV.
APPROVAL
OF AGENDA: Councilman Packineau moved to approve of the agenda, second by
Councilman Whitecalfe. VOTE: 6 Ayes 0
Nays Motion carried. V.
Resolution 10-012-VJB: LSA Judgment Issues Councilman Whitecalfe moved to approve of a resolution entitled,
“Lake Sakakawea & Associates, LLC Judgment –Resolution of Outstanding
Issues.” The motion is second by
Councilman Packineau. Discussion: This issue needs to be taken care of
before any loans can be approved. VOTE: 5 Ayes 1 Nays Motion carried. VI.
Oil Refinery Law Firm 2:03 Councilman Whitecalfe moved to approve of a resolution entitled,
“Engagement of Fredericks, Peebles, & Morgan to provide Legal Services for
TAT Clean Fuels Refinery.” The motion is
second by Councilman Packineau. Discussion: To
include a provision in the contract to say: “Not to engage in political
activities”. Council would like to start
as early as VOTE: 5
Ayes 0 Nays 1 Abstention (VJB) Motion carried. VII.
Resolution 10-014-VJB:
Property Purchase from James Williams Councilman Eagle moved to approve of a resolution entitled, “ Purchase of Real Property from James L.
Williams – Discussion: This
approval is based on TAT Legal Department to negotiate but not to exceed the
asking price of $300,000.00. This is fee
property and therefore will have higher taxes.
VOTE: 5 Ayes 1 Nays Motion
carried. VIII.
Lac Du Flambeau Default on
Bond with Wells TAT legal gave an update. IX.
Enrollment Salary Increase:
John Charging Councilman Whitecalfe moved to approve of a salary increase for
Ardis Marsette and John Charging in the amount of $2.00 each. The motion is second by Councilman Packineau. VOTE: 6 Ayes 0 Nays Motion carried. X.
ADJOURNMENT: Councilman Whitecalfe moved to adjourn the meeting, second by
Councilman Packineau. The meeting adjourned at CERTIFICATION I, the
undersigned, as Secretary of the Tribal Business Council of the Three Affiliated Tribes of the Fort
Berthold Indian Reservation, hereby certify that the Tribal Business Council is
composed of seven (7) members of
whom (5) constitute a quorum _____were
