SECRETARIAL ELECTION UPDATE TO AMEND THE TRIBAL CONSTITUTION FOR THE INCREASE OF THE TRIBAL COUNCIL MEMBERSHIP TO NINE (9) MEMBERS

The Tribal Business discussed the status of the Tribal Business Council Resolution #01-215-MWJR dated August 30, 2001 duly adopted by a affirmative vote of 7 member for and 0 opposed,  which requested in part:
The Tribal Business Received a update from Cora Jones, Regional Director, Great Plains Region of the Bureau of Indian Affairs
In a memorandum to Paige Baker, Supt. Of Fort Berthold Agency, dated February 1, 2002, which states as follows:
"Under Article X of the Constitution, the Three Affiliated Tribes (Tribes) Business Council (Council) adopted Resolution #01-215-MWJR proposing a change in the Tribes' Constitution to increase the Council membership from seven to nine members. We received confirmation from the Acting Director, Office of Indian Services, that this proposed change constitutes an amendment process and not a revision.
The proposed change also received favorable legal review by the Field Solicitor. Therefore, under the delegated authority of 3 IAM 4.4, this is to authorize you to call for an election on the proposed amendment (as identified in Resolution 01-215-MWJR) in accordance with the procedures in 25 CFR 81.
The attached outline of the Secretarial election process, which was distributed at the last Tribal Government Services conference, should be helpful
to you and the election board. We recommend the election board consider conducting this election through the United States Postal Service. This option is discussed in 25 CFR 81.18 9 c). It would save the cost of setting up polling stations and eliminate any concerns about adverse weather conditions on election day.  This authorization is void unless acted upon within 90 days. TRIBAL COUNCIL DEBATES, BUT TAKE NO ACTION ON THE PROPOSED CORPORATE CHARTER RESOLUTION AS PRESENTED BY CHAIRMAN HALL

The Tribal Business Council held a joint meeting with the Chief Executive Officer's of the Mandaree Electronics, Fort Berthold Development Corporation and the Twin Buttes Custom Homes Board. In regards to the Proposed Resolution of Chairman Tex Hall.
Proposed Resolution stated in part:
"Whereas, It is the initial wish of the Three Affiliated Tribes to place Fort Berthold Development Corporation, Four Bears Casino and Lodge, Twin Buttes Custom Homes, Inc., Mandaree Enterprises, Inc., Mandaree Solid Surfaces Corporation, Elbowoods Works and the Figure 4 Ranch and Buffalo Project, under the control of MHA Enterprises, Inc. as soon as practicable,…

However, after much debate no action was taken by the Tribal Business Council. However there was a motion made to develop a proposal to have all the construction companies possibly to be under one Tribal Holding Company. Which would include Twin Buttes Custom Homes, Mandaree Solid Surfacing, Elbowoods Works and the Fort Berthold Development Corporation only. Such proposal is to be brought back on March 13, 2002.
