Regular Meeting held on December 19, 2001--Action

Tribal Court Associate Judges Approved for the Calendar Year 2002
The Tribal Business Council approved the Associate Judges for the Calendar Year 2002 pursuant to Resolution #01-301-MWJR, which states in part:
"WHEREAS, It is the considered judgment of the Tribal Business Council that the Judiciary of the Three Affiliated Tribes must maintain exceptionally qualified judicial officers to uphold the laws and the customs of the Tribes; and
WHEREAS, The Tribal Business Council has selected P. Diane Johnson, B.J. Jones, Mike Swallow, and Terry Pechota to serve as the rotating Associate Judges in the Fort Berthold District Court during calendar year 2002; and
WHEREAS, The above named individuals are licensed attorneys and have significant experience in the area of federal Indian law and with tribal judicial forums;
NOW, THEREFORE, BE IT RESOLVED, That the Tribal Business Council of the Three Affiliated Tribes hereby formally appoints P. Diane Johnson, B.J. Jones, Mike Swallow, and Terry Pechota to serve as Associate Judges in the Fort Berthold District Court during the calendar year 2002.
BE IT FURTHER RESOLVED, That the Tribal Business Council hereby assigns the respective appointees to each serve on a rotating basis as presiding Associate Judge during the calendar year 2002 quarters as follows:
Mike Swallow: 1st (Jan, Feb, March)
B.J. Jones: 2nd (April, May, June)
Terry Pechota  3rd (July, Aug Sept)
P. Diane Johnson 4th (Oct, Nov, Dec)
BE IT FURTHER RESOLVED, That the rate of compensation for each appointee shall be Five Hundred ($500.00) per day per court session, in addition to reimbursement of documented travel expenses."
Chief Financial Officer Presents the FY-1998 Audit performed by KPMG
Mr. Steve Salveson, presented the FY-98 Audit performed by KPMG out of the Billings, MT office. And requested the Tribal Business Council accept the audit with denoted deficiencies. Therefore the Tribal Council went on record to accept such audit as presented.
Also, Mr. Salveson reported that the Audit for FY-99 will be completed by January 2002, the  Audit for FY-2000 will be completed by March 2002 and the Audit for FY-2002 will be completed by September 2002.
KDU Budget approved for FY2002 for the Amount of $1,066,667.
Tribal Business Council formally approved the Budget for the Kidney Dialysis Unit for the FY-2002 Budget Year for the amount of $1,066,667, which includes general fund revenue as well as third party revenue. KDU is back into full operation at this time.
