  MHA Nation Draft Probate (Inheritance) Code to Hold Public Comment Period

      Four Bears, ND - A Public Hearing to hear comments and review the draft Mandan, Hidatsa and Arikara Nation Probate Code will be held on September 20, 2012, at the 4-Bears Casino, Mandan room from 6:00 - 10:00 pm. The MHA Nation draft Probate Code will govern the descent and distribution of Indian trust interests in land and minerals. The U.S. Congress adopted the American Indian Probate Reform Act (AIPRA), effective June 20, 2006, to address the growing problem of fractionated Indian trust land ownership. The Act governs the descent and distribution of Indian trust lands and addresses fractionation through a National Probate Code; it also authorizes Tribes to develop probate codes that must be approved by the Department of Interior. Once approved all tribal member probates will be governed by the Tribes Probate Code although decisions will still be rendered by the Probate Judge with the Department of Interior Office of Hearings and Appeals.
      The Public Hearing will hear comments from tribal members and further explain the AIPRA and the draft MHA Nation Probate Code. Written comments are accepted and can be mailed or delivered to Diana Hale at Chairman Hall’s office at the Tribal Administration Building.
