83-005-STHEREFORE BE IT RESOLVED, that the Tribal Business Council approve the partition of lands held in trust by the United States of America for the Three Affiliated Tribes and lands held in trust by the United States of America for Karen White Clay , 301-U2583 under the terms and conditions as stated below and hereby authorizes the Chairman of the Tribal Business Council, its Secretary, the Superintendent of the Fort Berthold Agency, the Area Director, and the Commissioner of Indian Affairs to prepare all documents and do all things necessary to partition lands for which title is to be transferred to the United States of America in trust for the , Three Affiliated Tribes and Karen White Clay , 301-U2583 under the terms and conditions as stated below: That the partition of Allot. 83-010-SNOW THEREFORE BE IT RESOLVED to protect all interests, tribal, state, federal and private against the evils of waste in the production and utilization of oil and gas affecting the Fort Berthold Indian Reservation as well as safeguard the co-equal and correlative rights of the owners and producers of the common source of oil and gas underlying the Fort Berthold Indian Reservation in whole or in part the Three Affiliated Tribes Business Council hereby agrees to enter into an agreement with the State of North Dakota to place a council member on the Industrial Commission; and THEREFORE BE IT FURTHER RESOLVED that the Tribal Business Council appoints Mr. Dennis Huber to participate on the State Industrial Commission and Mr. Gerald White as his alternate, furthermore if neither of the above council members can attend a hearing or proceeding affecting the Fort Berthold Indian Reservation the Tribal Chairman may designate any other council member, or the Natural Resources Department Administrator, or a tribal member to discharge the assigned duties; and THEREFORE BE IT FURTHER RESOLVED that the Natural Resources Department Administrator, or his designee shall be present at all hearings or proceedings affecting the Fort Berthold Indian Reservation. 1/13/1983YActive

83-011-SNOW, THEREFORE BE IT RESOLVED, that the Three Affiliated Tribes Tribal Business Council urges the Department of Housing and Urban Development to expedite the approval of these plans on these projects (ND 5-10 & ND 5-13) as they have been developed, and not to impose any restrictions due to new minimum property standards.1/13/1983YActive

83-012-SNOW THEREFORE BE IT RESOLVED, Tribal Business Council Members now serving on school boards must resign, remove himself/herself from school boards effective immediately; and BE IT FURTHER RESOLVED, that the Tribal Business Council of the Fort Berthold Reservation support and adopt this resolution for the benefit of keeping out schools out of political interference and to provide education and welfare to our Indian Youth. 1/13/1983YActive

83-013-SNOW THEREFORE BE IT RESOLVED, That: 1. The minimum shot hole fee paid to surface owners be set at $150.00 per shot hole; and $150.00 per mile for access, retroactive to September 1, 1982 to include payment for those shot holes that have not been paid as of September 1, 1982 and thereafter. 2. The minimum shot hole fee paid to lessees (Farming and Grazing be set at $25.00 per shot hole; and
3. The minimum vibroseis fee be set at $400./00 per mile; and
4. Damages involving leased farm lands (cultivated) will be negotiated with the lessee. The following formula shall be applied to determine damages:
a. Width of track (linear feet) X length of line (linear feet) = acreage (1 acre = 43,560 sq. ft.),
b. Estimated yield per acre (bushels, etc.) x acreage = total yield,
c. Total yield X market value of crop )at time of settlement of damages) = damages.
If this formula does not serve the requirements necessary to determine damage or if it is deemed to be unacceptable by all of the affected parties a more applicable formula
will be developed by the affected parties and if agreed on by all affected parties, that formula shall be used.
BE IT FURTHER RESOLVED, That this resolution rescinds all previous applicable resolutions.1/13/1983YActive

83-014-SNOW, THEREFORE, BE IT RESOLVED, That the Tribal Business Council, pursuant to its Constitutional power and authority, hereby formally approves adoption of the attached provisions entitled "Commitment Procedure," which provisions shall forthwith be designated as Section 14 of Chapter II of the Code of Laws of the Three Affiliated Tribes of the Fort Berthold Reservation.  BE IT FURTHER RESOLVED, That said attached provisions entitled "Commitment Procedure" shall take effect immediately.  1/13/1983YActive

83-015-SNOW, THEREFORE, BE IT RESOLVED, That the Tribal Business Council, pursuant to its Constitutional power and authority, hereby formally approves adoption of the attached provisions entitled "Guardianship Procedure," which provisions shall forthwith supersede and replace the provisions currently set forth in Section 11 of Chapter II of the Code of Laws of the Three Affiliated Tribes of the Fort Berthold Reservation, and shall be so designated as Section 11 of Chapter II of said Code of Laws and shall be so entitled "Guardianship Procedure."  BE IT FURTHER RESOLVED, That said attached provisions entitled "Guardianship Procedure" shall take effect immediately. 1/13/1983YActive

83-016-SBE IT RESOLVED, that the Three Affiliated Tribes' Human Resources Department exists for the specific purpose of maintaining the health and safety standards of the residents of the Reservation; and BE IT FURTHER RESOLVED, that the Three Affiliated Tribes' Human Resource Department shall be authorized to apply for and administer funds to be used to provide for community education on children in automobiles; and BE IT FURTHER RESOLVED, that grant funds will also be used to provide proper child safety restraint equipment on a loan basis to community members in need of such equipment; and BE IT FURTHER RESOLVED, that the Administrator, Human Resources Department, shall act as project coordinator and the attached shall be the plan of operation for the coming Fiscal Year 1983. 1/13/1983YActive

83-020-SNOW THEREFORE BE IT RESOLVED that the Executive Board Is empowered to enter into a contract with Ron Holt, d/b/a Red Eagle Productions, Box 612, Crow Agency, Montana 57022 to provide one television program of one-half (%) hour per month for twelve (12) months with the following stipulations: a. All video tapes, and footage not used, shall be the property of the Three Affiliated Tribes for historical and preservation purpose. b. The Three Affiliated Tribes does hereby appropriate a sum not to exceed $30,000 or $2,400 per month for social program. c. The Three Affiliated Tribes shall not be responsible for compensating any television station for the air time of such shows. 1/13/1983YActive

83-022-SNOW THEREFORE BE IT HEREBY RESOLVED by the Tribal Business Council of the Three Affiliated Tribes that the Revenue Sharing Budget adopted by the public is as follows: Tribal Business Council, North Segment, West Segment, East Segment, Four Bears, Northeast Segment, South Segment, BE IT FURTHER RESOLVED that this budget for Entitlement Periods 13 and 14 shall be on file for public view for ten days

83-024-SNOW, THEREFORE, BE IT RESOLVED, That the Tribal Business Council hereby directs the Fort Berthold Development Corporation to forthwith negotiate and enter into a joint venture agreement with the said Martell Associates, subject to the ratification of any such agreement by the Tribal Business Council. BE IT FURTHER RESOLVED, That the Tribal Business Council hereby directs the administrative staff of the' Fort Berthold Housing Authority to activate the necessary procedures to insure the successful implementation of the Tribes' joint venture project.  2/3/1983YActive

83-026-SNOW THEREFORE BE IT RESOLVED, That the Three Affiliated Tribes under the authority of Title II of the Indian Child Welfare Act contracts with the Bureau of Indian Affairs for financial assistance in the amount of $150,000.00 for the Human Resources Department Child Welfare Component for one year period, beginning 1983.  |BE IT FURTHER RESOLVED, That the Chairman, Vice-Chairman, Secretary, or Treasurer of the Three Affiliated Tribes shall be allowed to negotiate and sign on behalf of the Tribal Business Council.  2/3/1983YActive

83-027-SNOW, THEREFORE, BE IT RESOLVED, by the Tribal Business Council.to establish the following input procedures on all meetings held with Bureau of Indian Affairs be as follows: 1) That the Bureau of Indian Affairs notify the Tribal Business Council of all meetings,

83-030-SNOW, THEREFORE, BE IT RESOLVED, That the Tribal Business Council of the Three Affiliated Tribes does hereby formally request that North Dakota Project No. AHL-51(S) be classified as at least a fifty percent (50%) minority set-aside project by the State of North Dakota, and further that the Bureau of Indian Affairs assist the Three Affiliated Tribes in achieving this goal through negotiation with the State of North Dakota. 83-036-STHEREFORE BE IT RESOLVED, that the Fort Berthold Tribal Council fully support the passing the re-authorization of the Vocational Education Act of 1963 with the Language providing for an Indian Set A Side of 1%. BE IT FURTHER RESOLVED, that the Three Affiliated  Tribes Business Council fully supports the provision that this 1% set a side be matched by the Bureau of Indian Affairs "dollar for dollar" and that no Congressional waiver is issued to the B.I.A. and they be mandated to provide the match required. 2/17/1983YActive

83-038-SNOW, THEREFORE BE IT RESOLVED that the Tribal Business Council of the Three Affiliated Tribes hereby approves the lump sure payment of the allocated $38,991.20 Community Development Funds for 1982 and 1983 to the White Shield Community, East Segment of the Fort Berthold Reservation to be used toward Community projects, services and/or expenses of existing community projects. BE IT FURTHER 'RESOLVED that the Chairperson and the Treasurer of the White Shield Community Development Corporation be bonded, and all checks be signed by Treasurer and countersigned by Chairperson. Also, that three additional requirements be made. First, monthly financial statements must be furnished the Tribal Comptroller, Tribal Finance. Second, within five (5) days after receiving their bank statement, the White Shield Community Corporation must mail the bank statements with all checks/deposits and the bank reconciliation to the Tribal Comptroller, Tribal Finance. Third a complete audit may be performed any time upon the request of the Tribal Treasurer, or the Tribal Comptroller, The audit shall be performed by the Tribal Comptroller.  2/18/1983YActive

83-040-SNOW, THEREFORE, BE IT HEREBY RESOLVED, that the Tribal Business Council Treasurer be authorized to set salary, travel and per diem rates for each individual Councilman that will not exceed the amount set forth in the Tribal Budget for Tribal Councilmen's salary,
BE IT FURTHER RESOLVED that Councilmen be paid an additional Thirty Dollars ($30.00) per day subsistence for overnight lodging in New Town or Four Bears
Motel (payment as per motel receipt) and a monthly automobile maintenance allowance for travel of distances one way: $150.00 per month over 100 miles; $120.00 per month over 80 miles; $90.00 for 60 miles; $75.00 for 50 miles; $60.00 for 40 miles; and $30.00 for 20 miles. 83-042-SNOW, THEREFORE, BE IT RESOLVED, that the Tribal Business Council of the Three Affiliated Tribes hereby approves the lump sum payment of the allocated Community Development Funds for 1982 to the communities of North Segment, South Segment, West  Segment, Northeast Segment of the Fort Berthold Reservation to be used toward Community projects, services and/or expenses of existing community projects.
